Terms and Conditions for The Founders Program Application
By submitting your application for The Founders Program l Powered by Fixer®, you agree to the following terms and conditions:
1. Application Statement:
You affirm that all information provided in the application is true and accurate to the best of your knowledge. Providing false or misleading information may lead to disqualification from the selection process or The Founders Program.
2. Selection Process:
The Founders Program reserves the right to accept or reject any application at its discretion. There is no guarantee of acceptance into The Founders Program.
3. Use of Personal Information:
By submitting your application, you grant permission for The Founders Program, Fixer and Academia Cerebra to use your contact information (including but not limited to email address and phone number) for the purpose of marketing communications related to The Founders Program, Fixer, Academia Cerebra and their associated activities. You may unsubscribe from these communications at any time.
4. Future Terms and Conditions:
If accepted into The Founders Program, you will be required to agree to additional terms and conditions pertaining to your participation in The Founders Program, which will be made available to you at that time.
5. Failure to Pay Program Fee and/or Establish Advisor Equity Grant
If accepted into The Founders Program, you will be required to (i) pay the Program fee deposit and the remaining balance within the specified timeframes and (ii) establish the advisor equity grant to The Founders Program within the designated period. Failure to make timely payments or establish the advisor equity grant may result in disqualification from The Founders Program. In the event of disqualification, at The Founders Program’s discretion, you will forfeit any deposits or fees already paid.
6. Confidentiality:
All information shared in the application process will be treated with confidentiality. However, you should note that The Founders Program may share aggregated non-identifiable data for research and marketing purposes.
7. Changes to Terms:
The Founders Program reserves the right to modify these terms and conditions at any time without prior notice.
8. Program Postponement, Cancellation or Discontinuation:
The Founders Program reserves the right to postpone or adjust the timing of the The Founders Program, or to determine not to run The Founders Program or to discontinue it at any time, for any reason, including but not limited to insufficient enrollment, or unforeseen circumstances. In the event that The Founders Program is not run or is discontinued after participants have paid Program fees, participants will be notified promptly, and any fees paid will be refunded in full. However, the Program is not responsible for any costs or expenses incurred by participants in anticipation of the Program, and fees will not be refunded in the event of a postponement or timing adjustment only. You acknowledge and accept that the continuation or availability of The Founders Program is not guaranteed and that The Founders Program may modify, suspend, or terminate the program at its discretion.
9. Intellectual Property:
Fixer® and Powered by Fixer® are registered trademarks of Fixer Advisory Group LLC. All rights related to these trademarks are reserved and protected under applicable trademark laws. All content, materials, and resources presented on The Founders Program website, marketing and promotional materials, and throughout The Founders Program, including text, graphics, logos, videos, and other intellectual property, are copyrighted and owned by Fixer Advisory Group LLC or its affiliates. Unauthorized use, reproduction, distribution, or modification of any copyrighted materials is strictly prohibited and may result in legal action. Program participants are granted a limited, non-exclusive, non-transferable license to use the program materials for their personal, internal business and educational purposes only. Any other use or distribution requires prior written permission from Fixer Advisory Group LLC.
10. Use of Application Materials
By submitting an application to The Founders Program, you grant The Founders Program and Academia Cerebra the right to use all submitted materials for the purpose of evaluating your suitability for the Program. This includes, but is not limited to, application forms, statements, and any supporting documents. You acknowledge that The Founders Program may retain copies of all application materials for internal purposes, including record-keeping, Program improvement, and research. All application materials will be handled in accordance with applicable privacy laws and regulations.
11. Program Disclaimers:
The Founders Program offers resources, support, and educational content designed to assist participants in enhancing their business skills and strategies. However, The Founders Program makes no representations or warranties of any kind, express or implied, about the potential outcomes of the Program. Participation in The Founders Program does not constitute legal, financial, investment, tax or professional advice. You are encouraged to seek independent legal, financial, investment, and tax counsel before making business decisions based on information, guidance, or resources provided through The Founders Program. The Founders Program does not guarantee success, profitability, or any specific results following participation. Individual results may vary based on numerous factors, including but not limited to personal commitment, market conditions, and the unique circumstances of each founder and business.
12. Liability Waiver:
The Founders Program and its partners (including Fixer and Academia Cerebra) will not be liable for any loss, injury, or damage incurred as a result of your participation in the application process or if accepted, in the Program itself.
13. Governing Law:
These terms and conditions will be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
14. Dispute Resolution:
Any disputes, claims, or controversies arising out of or relating to these terms and conditions, the application process, or participation in The Founders Program shall be resolved through mandatory mediation. If mediation fails to resolve the dispute within 30 days, the parties agree to submit the dispute to binding arbitration, to be conducted by JAMS (Judicial Arbitration and Mediation Services) in accordance with its rules and procedures. The arbitration shall take place in New York, NY, and the decision of the arbitrator shall be final and binding on both parties. Each party shall bear its own costs and attorney fees associated with the arbitration, and the costs of the arbitration shall be shared equally, unless otherwise determined by the arbitrator. By agreeing to these terms, you waive your right to a jury trial and to bring or participate in any class action or representative proceeding.
15. Severability:
If any part of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. Acceptance of Terms:
By clicking "submit," you acknowledge that you have read these terms and conditions, understand them, and agree to be bound by them.
